Agreement to these terms

By using trybio1.com or placing an order, you agree to be bound by these Terms of Service in full. If you do not agree, do not use this website or place an order. These terms apply to all visitors, customers, and users of the site.

Who we are

This website is operated by Bella Altidore Inc., doing business as BIO 1. References to “BIO 1,” “we,” “us,” and “our” mean Bella Altidore Inc. Contact us at support@trybio1.com

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By placing an order you confirm that you meet this requirement. We reserve the right to cancel any order where we have reason to believe this requirement has not been met.

Health information and disclaimers

BIO 1 is a dietary supplement. The information on this website is for general informational purposes only and does not constitute medical advice. These statements have not been evaluated by the Food and Drug Administration. BIO 1 is not intended to diagnose, treat, cure, or prevent any disease.

Consult a licensed physician or qualified healthcare professional before using BIO 1 if you are pregnant, nursing, trying to conceive, taking any medication, or have any medical condition. Do not exceed the recommended serving. Discontinue use and seek medical attention if you experience an adverse reaction. Individual results vary and are not guaranteed. By purchasing BIO 1, you acknowledge that you have read this disclaimer and accept sole responsibility for your decision to use the product.

Products and descriptions

We work to describe our products accurately. Colours on screen and packaging details may vary slightly from what is shown. We reserve the right to limit quantities, discontinue products, modify product formulas or descriptions, or update product details at any time without notice. We do not guarantee that product descriptions are complete, accurate, or current.

Prices and payment

Prices are displayed in the currency shown on the website. Taxes are calculated at checkout. Promotional pricing and discounts are subject to their stated terms and may be withdrawn at any time without notice. If a product is listed at an incorrect price due to a system or pricing error, we reserve the right to cancel the affected order and issue a full refund, regardless of whether the order has been confirmed.

Orders and our right to refuse

Your order constitutes an offer to purchase. A contract is formed when we confirm your order by email. We reserve the right to refuse, limit, or cancel any order at our sole discretion — including where a product is unavailable, where we suspect fraud or policy abuse, where pricing or inventory errors have occurred, or for any other reason. If we cancel a paid order, you will receive a full refund. We also reserve the right to refuse service to any person or entity at any time.

Subscriptions

If you purchase a subscription, your order will renew automatically at the end of each billing period and your payment method will be charged accordingly. By placing a subscription order, you expressly agree to these auto-renewal terms. We will send you a reminder email 3–5 days before each upcoming charge so you are always informed of the billing date and amount. It is your responsibility to manage, modify, or cancel your subscription before the next renewal date. Failure to cancel before renewal does not constitute grounds for a refund. Subscriptions can be cancelled by logging into your account, by emailing support@trybio1.com, or through your customer portal. Cancellations take effect at the end of the current billing period and no further charges will be made.

Goods for personal use only — no resale

BIO 1 products are intended for personal, non-commercial use only. You may not resell, redistribute, export, or modify our products without our prior written consent. We reserve the right to refuse or cancel orders that appear, in our sole judgment, to be placed by dealers, resellers, or distributors. Unauthorized resale of BIO 1 products on third-party platforms, marketplaces, or websites is strictly prohibited.

Shipping, refunds and returns

Our Shipping Policy and Refund Policy form part of these terms and govern all matters relating to delivery, returns, cancellations, and our 90-day money-back guarantee.

Chargebacks and payment disputes

Before initiating a chargeback or dispute with your payment provider, you agree to contact us at support@trybio1.com and allow us a reasonable opportunity to resolve the issue. Filing a chargeback while a resolution is in progress, or for a purchase that falls within our refund guarantee, may be treated as a breach of these terms. We reserve the right to contest any chargeback we believe has been filed improperly or in bad faith, to provide evidence of the transaction and delivery to the relevant payment processor, and to report fraudulent disputes to payment networks. Chargebacks filed without prior contact may also result in temporary suspension of your account.

Electronic communications

By placing an order or creating an account, you consent to receive electronic communications from us, including order confirmations, shipping updates, account notices, and policy updates, sent to the email address you provide. You agree that electronic communications from us satisfy any legal requirement that such communications be in writing. It is your responsibility to keep your email address current and accurate.

SMS and text message communications

If you opt in to receive SMS or text messages from BIO 1, you consent to receive recurring transactional and marketing text messages at the mobile number you provide. Message frequency varies. Message and data rates may apply. Your consent to receive SMS messages is not a condition of any purchase.

You may opt out at any time by replying STOP to any message. For assistance, reply HELP or email support@trybio1.com. Carriers are not liable for delayed or undelivered messages. SMS opt-in data and consent will not be shared with third parties for marketing or promotional purposes, except as necessary to operate the messaging program (such as with our messaging service provider).

Promotions and giveaways

Promotions, contests, or giveaways run by BIO 1 may be subject to separate official rules posted at the time of the promotion. Those rules control in the event of any conflict with these terms.

Prohibited uses

When using this website, you agree not to, directly or indirectly:

Use the site for any unlawful purpose or in violation of any applicable law or regulation
Impersonate any person or entity, or misrepresent your affiliation with any person or entity
Submit false, misleading, or fraudulent information
Harass, defame, abuse, or discriminate against any person
Distribute viruses, malware, or other harmful code that may affect the security or operation of the site
Use scrapers, bots, or automated tools to collect data from the site without our express permission
Attempt to gain unauthorized access to any part of the site, its systems, or other users’ accounts
Use the site or its content to build competing products or services, or for any unauthorized commercial purpose
Resell, redistribute, or export our products in violation of these terms

We reserve the right to terminate your access to the site for any violation of these prohibited uses.

Reviews and user content

By submitting a review, photo, or other content, you confirm it is truthful, reflects your genuine personal experience, and that you have the right to share it. You grant Bella Altidore Inc. a non-exclusive, royalty-free, perpetual, worldwide licence to use, display, adapt, and distribute the content across our website and marketing materials, with your name or initials as provided. We may remove any content at our discretion without notice. We do not tolerate fake, incentivized, or misleading reviews and reserve the right to report violations to applicable consumer protection authorities.

Intellectual property

The BIO 1 name, logo, text, images, design, and all other content on this website are owned by or licensed to Bella Altidore Inc. You may not copy, reproduce, distribute, modify, or use any of this content for any commercial purpose without our prior written consent. Unauthorized use may give rise to a claim for damages.

Links to external websites are provided for convenience only. We are not responsible for the accuracy, content, or privacy practices of any third-party website. Our inclusion of a link does not imply endorsement.

Disclaimer and limitation of liability

This website and our products are provided on an “as is” basis, without warranties beyond those required by applicable law. We make no warranty that the website will be uninterrupted, error-free, or free of viruses or other harmful components. To the fullest extent permitted by law, Bella Altidore Inc. is not liable for any indirect, incidental, special, consequential, or punitive damages of any kind arising from your use of this website or our products, including but not limited to loss of revenue, loss of data, or personal injury. Indemnification

You agree to indemnify, defend, and hold harmless Bella Altidore Inc., its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of this website, your violation of these terms, your misuse of our products, or your infringement of any third-party right.

Dispute resolution and arbitration

In the event of a dispute arising from these terms or any purchase, you agree to first contact us at support@trybio1.com and attempt to resolve the matter informally. If a resolution cannot be reached within 30 days, the dispute will be resolved by binding individual arbitration under the applicable rules in the Province of Ontario, rather than in court. You waive any right to participate in a class action lawsuit or class-wide arbitration against Bella Altidore Inc. Each party will bear their own costs unless the arbitrator determines otherwise.

Either party may bring an individual claim in small claims court where jurisdictional requirements are met. Nothing in this section prevents either party from seeking injunctive or other equitable relief in court to protect intellectual property or prevent irreparable harm. For users located outside Canada, this arbitration provision does not deprive you of mandatory protections under the consumer laws of your country of residence.

Force majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, pandemics, strikes, carrier disruptions, government actions, or internet outages.

Governing law

These terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without prejudice to any consumer rights you hold under the laws of your place of residence.

No assignment

You may not assign or transfer any of your rights or obligations under these terms to any other person or entity without our prior written consent. Any attempted assignment without consent is void. We may assign our rights under these terms without restriction.

No waiver

Our failure to enforce any right or provision of these terms at any time does not constitute a waiver of that right or provision. Any waiver is only effective if made in writing.

No third-party beneficiaries

These terms do not and are not intended to confer any rights or remedies on any person other than you and Bella Altidore Inc.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Changes to these terms

We may update these terms at any time by posting the revised version on this page. The version in effect at the time you place an order is the version that applies to that order. Your continued use of this website after changes are posted constitutes your acceptance of the updated terms.
